Hold Harmless and Volunteer Waiver Agreement

This Volunteer Hold Harmless and Waiver Agreement ("Agreement") is entered into by and between the undersigned Volunteer ("Volunteer") and Keystone Spark Academy, a nonprofit organization ("KSA"), collectively referred to as the “Parties.”

1. The Volunteer agrees to provide unpaid services to KSA which may include, but are not limited to, mentorship, event support, classroom assistance, administrative help, and outreach activities.

2. Acknowledgment of Risks - The Volunteer understands that participation in KSA activities may involve physical activity, interaction with minors, travel, use of tools/equipment, and other risks that could result in injury, illness, or property damage. The Volunteer affirms they are voluntarily participating with full knowledge of these risks.

3. Hold Harmless and Waiver of Liability - To the fullest extent permitted by law, the Volunteer agrees to release, indemnify, defend, and hold harmless Keystone Spark Academy, its officers, directors, employees, agents, successors, and assigns from and against any and all claims, liabilities, damages, losses, or expenses (including attorneys’ fees) arising out of or in connection with: The Volunteer’s participation in any KSA-related activity Injury, illness, or death of any person Damage to property Alleged negligence by KSA or its representatives.

4. Medical Treatment - The Volunteer consents to receive emergency medical treatment in the event of injury or illness during KSA activities and agrees to be responsible for any associated costs.

5. Background Checks and Conduct - The Volunteer agrees to submit to any required background checks, comply with all KSA policies, and conduct themselves in a manner that upholds the values and safety of the organization.

6. Insurance - The Volunteer understands they are not covered by KSA’s insurance policies and are encouraged to maintain their own health and liability coverage.

7. Photo, Video, and Audio Release - I grant Keystone Spark Academy permission to record, photograph, or capture my (or my child’s) likeness, voice, and performance during program activities and to use such media in promotional, educational, or fundraising materials in any format (print, web, social media, video, etc.) without compensation.

8. Transportation Release (If applicable) - I understand that participation may involve off-site travel. I authorize Keystone Spark Academy, its staff, and authorized volunteers to provide transportation via private vehicle, chartered bus, or other approved means. I release KSA from liability arising from such transportation.

9. Communications Consent - I consent to receiving communications from Keystone Spark Academy via phone, email, or text message regarding scheduling, updates, program announcements, or emergencies.

10. Technology and Internet Use Agreement (For digital programs or students) - If participating in a program involving computer use or online engagement, I agree to use KSA’s technology resources respectfully and lawfully. I will not access inappropriate content or misuse equipment.

11. Binding Agreement - This Agreement shall be binding upon the Volunteer, their heirs, executors, legal representatives, and assigns, and shall be governed by the laws of the state in which Keystone Spark Academy operates. Violation of any of the terms, policies, or behavioral expectations outlined in this Agreement may result in immediate suspension or termination of the individual’s volunteer role. At the discretion of Keystone Spark Academy, such a violation may also result in the individual being barred from future volunteering opportunities or participation in any Keystone Spark Academy programs or events.
